The problem

A vendor owed our client money under a services agreement with an arbitration clause — then ignored the notice and refused to agree on an arbitrator.

What we did

We served the notice invoking arbitration and, when the thirty days ran out, petitioned the High Court under Section 11 of the Arbitration and Conciliation Act, 1996 to appoint one.

Outcome

An arbitrator appointed by the court, and the claim in front of someone with the power to decide it.
